Real estate tax in Panama: how the Main Dwelling regime can reduce (or eliminate) your payment

Many property owners in Panama pay more real estate tax than they should, simply because they have not registered their home under the Main Dwelling or Family Tax Estate regime. This benefit, introduced by Law 66 of 2017, exempts the first B/. 120,000.00 of the cadastral value of the property from tax. In many cases, the home becomes entirely free of real estate tax. Below we explain what it consists of and how to obtain it.

What are the Family Tax Estate and the Main Dwelling? They are two figures that the law treats equivalently for purposes of the tax benefit. Family Tax Estate: the property that the owner permanently uses as the family's dwelling, living under the same roof. Main Dwelling: the property that a natural person uses as a permanent residence and that does not constitute a family estate. In both cases, the property must be used as a permanent home, and a person or family may only claim the benefit for one property.

The benefit: exemption up to B/. 120,000. Properties registered as a Main Dwelling or Family Tax Estate are exempt from real estate tax on the first B/. 120,000.00 of their cadastral value (including improvements). Preferential rates apply to any amount above that: up to B/. 120,000.00, exempt (0%); from B/. 120,000.01 to B/. 700,000.00, 0.50%; over B/. 700,000.00, 0.70%.

Additional benefit for first-time home buyers. The law provides a special incentive for those who acquire their first home and register it as a Family Tax Estate or Main Dwelling: if the cadastral value is between B/. 120,000.00 and B/. 300,000.00, the property is exempt from real estate tax for a period of three years.

How does it differ from other properties? Properties not registered under this regime —such as second homes, commercial premises or land— are taxed at higher rates with a much lower base exemption. Registering your home correctly can therefore represent significant savings year after year.

How is the benefit obtained? The benefit is not automatic: the property must be applied for and registered as a Main Dwelling or Family Tax Estate before the General Revenue Directorate (DGI). Broadly, the process requires proving ownership, that the property is used as a permanent residence and that the applicant does not already enjoy the benefit on another property. Once registered, the exemption is reflected on the property's account.
